Welcome to Hues! These Terms and Conditions ("Terms") govern your access to and use of the Hues mobile application ("App") and its services ("Services"). By using Hues, you agree to comply with and be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific services.
2. Age Requirement
You must be at least 13 years old to use Hues. By creating an account or using the App, you confirm that you meet the minimum age requirement. If you are under the age of 18, you must have parental or guardian consent to use the App. Hues reserves the right to terminate any account if it is discovered that the user does not meet these age requirements.
3. User Accounts
- You must create an account to access features of Hues.
- You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- You agree to provide accurate and complete information when creating an account and to update this information to keep it accurate and complete.
4. User Conduct
By using Hues, you agree not to:
- Post or share any content that is illegal, offensive, inappropriate, or violates the rights of others.
- Harass, threaten, bully or mistreat other users.
- Share content that contains false information or misrepresents facts.
- Engage in any activity that could harm Hues or its users. Expressive posts that could trigger others must be kept private.
- Use the App for commercial purposes without our explicit permission.
- Use the App for purposes other than it's intended purpose - for users to creatively express themselves to gain short term or long term improvement of their mental health.
5. Content Ownership and Rights
- You retain ownership of any content you create and post on Hues ("User Content"). However, by posting User Content, you grant Hues a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with the App and its services.
- You represent and warrant that you have the right to post your User Content and that such content does not infringe on the rights of any third party.
6. Reporting and Moderation
- Users have the option to report content that violates these Terms or the community guidelines. Reportable content includes, but is not limited to:
1. Inappropriate content
2. Harassment or bullying.
3. Spam or irrelevant content.
4. Misinformation or false information.
5. Hate speech or discrimination.
6. Violence or threats.
7. Privacy violations.
8. Impersonation or fraud.
9. Copyright or intellectual property violations.
- Hues reserves the right to review reported content and take appropriate action, including removal of content and suspension or termination of accounts.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Third-Party Links and Services
The App may contain links to third-party websites or services. Hues is not responsible for the content, privacy practices, or activities of these third parties. Any transactions or interactions with third-party services are solely between the user and the third party, and Hues shall not be liable for any issues arising from these interactions.
9. Termination
Hues reserves the right to suspend or terminate your account at any time, for any reason, including violation of these Terms or engaging in conduct that we determine to be inappropriate or harmful.
10. Disclaimer of Warranties
Hues is provided on an "as is" and "as available" basis. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for any content posted by users or third parties.
11. Limitation of Liability
To the fullest extent permitted by law, Hues shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.
12. Indemnification
You agree to indemnify and hold Hues, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, losses, liabilities, damages, costs, and expenses, including attorneys' fees, arising out of your use of the App, your User Content, or your violation of these Terms.
13. Changes to Terms
Hues may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after any changes constitute your acceptance of the new Terms.
